This agreement (the “agreement”) is a legal agreement between you and Personal Touch (the sole owner of its brand “silverrage” & “this Instamojo Store “), herein after mentioned as silverrage, that states the terms and conditions under which you may receive the silverrage service and use this website.

If you use the Silverrage service or this website, we assume that you do agree to the following terms and conditions –

1. SILVERRAGE SERVICE :

The silverrage service is a transaction, information and communication service available to authorized users (“customers”) who access our website. This portal currently provides an online shopping and a delivery service, and may in the future provide additional shopping and related services.

The website's employees, agents or designees will deliver orders on our portal within India. Prices of products sold online may differ from those available in the retail stores. Delivery will be made to the delivery address that you specify when your order is placed and confirmed. Prices for products placed in your cart will be guaranteed for that particular transaction.

You are responsible for ensuring that someone is present at the delivery address to receive the order and if not, we expect to be notified well in time to forward the concern the courier service’s office. Anyone at the delivery address who receives the order is conclusively presumed to be authorized to receive the same.

If we are subjected to process a re-dispatch of the order since no one was available at the delivery or if a wrong address / details were given to us by you, the customer is liable to pay an additional fee.

Incase you are not satisfied for any reason with an item purchased through the www.silverragestore.com, you may call us ‘at the time of receiving your order’ on (011-41010299 between 10 am to 2 pm on weekdays) or https://wa.me/919891021711.

Silverrage.com’s liability for missing a delivery is limited to delivery at a later agreed time at no additional charge.

(a)   PRICING :

We display the MRP or the Sale/Discounted Price under each product which includes GST @ 3% applicable on Silver Ornaments.

However, for a successful purchase the customer will be required to pay the Price Mentioned + A Convenience Fee (Price mentioned + (3% of Price mentioned + Rs 3 + GST @ 18%)) since the portal is managed, supported and owned by a third party called Instamojo (www.instamojo.com)

For example, a product worth Rs. 1000/- will carry a convenience fee of Rs. 38.94/-

*NOTE* This will not be applicable if the orders are placed with us via Whatsapp or Instagram

The prices mentioned at the time of placing the order will be applicable at the time of delivery as well. Prices for our products are subject to change without notice and they are completely under our discretion.

STRATEGY - 

Since we are not wholesalers, bulk suppliers, the weight alone does not determine the selling price. 

The designs methodology, the casting model cost, labour , rhodium plating, buffing, polishing, in house transportation cost, shipping charges, packaging charges , raw material procuring costs, constant fluctuation in silver prices, ALL TOGETHER decide the final price of any design. 

(b)  CANCELLATION POLICY :

As a policy we do not cancel any order after it is processed, which would be intimated vide an e mail or sms (delivery confirmation of the email or sms are subject to the functioning of the service provider of the same). However, if there are changes in the delivery slot time you requested or need to add more products, you need to call us on customer care number (011-41010299 at the specified days and hours).

Please note: if we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the website, we at our sole discretion could cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.

2. PROPERTY RIGHTS:

All the content on this website including (but not limited to) designs, text, graphics, interfaces, and the selection and arrangement thereof, and all software are the properties of silverrage.com, all rights reserved, or its content providers.

The portal authorizes you to view and copy for the sole purpose of placing an order with us, for your personal use, provided that you preserve any copyright or other proprietary notices. Any other use of materials on our website , including (but not limited to) reproduction, modification, distribution or publication for any commercial or public purposes, without the prior written permission by our team is strictly prohibited. We reserves the right to revoke this authorization at any time, and any use shall be discontinued immediately on written notice from Silverrage.

All other trademarks, service marks, product names and company names or logos appearing on this website are the property of their respective owners.

3. YOUR ACCOUNT:

By reading our policies along with the interest to place an order with us, we assume that you agree to provide our portal with accurate and complete information as required in registration process (“customer registration data”), including (but not limited to) your legal name, billing and delivery addresses, telephone number and to promptly notify us incase of any change in your customer registration data on 011-41010299 or a whatsapp message on +919891021711.

Upon registration, your username and password will allow you to access the website's service. Your password should be kept strictly confidential to prevent unauthorized usage.

Price and availability of products are also subject to change without notice. We reserve the right to correct online pricing errors. In such events, we reserve the right to correct the pricing error or cancel undelivered orders for any incorrectly priced products. You will be contacted in such circumstances. If any change is unacceptable to you, you may cancel your silverrage service/order and terminate this agreement.

7. DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY:

We at Silverrage believe in providing our customers the best of quality and services. Our manufacturing unit provides exclusive 925 Stamp on nearly all designs we make. Some pieces, due to their intricate design and space constraints cannot be hallmarked. However, the care cards sent along provide all the necessary information.

14. LEGAL AND MISCELLANEOUS:

These terms of service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. The clauses as above shall survive the termination or expiry of this agreement. This electronic record is generated by a computer system and does not require any physical or digital signatures.

(A) ARBITRATION

If any dispute arises between you and our poratl during your use of the website or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the user agreement and terms and conditions the dispute shall be first referred to a sole arbitrator who shall be an independent and neutral third party identified by us. The place of arbitration shall be New Delhi. The arbitration & conciliation act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.

(B) APPLICABLE LAW

This site is created and controlled by Instamojo. The laws of India shall apply and courts in Delhi shall have jurisdiction in respect of all the terms, conditions and disclaimers. We and Instamojo reserve the right to make changes to the website and the terms, conditions and disclaimers at any time and without information to the customers/users of the services/website of our portal.
